VIOLÊNCIA FÍSICA E PSICOLÓGICA CONTRA A MULHER EM TEMPOS DE PANDEMIA
Este artigo tem por objetivo geral investigar dados sobre a violência física e psicológica contra a mulher em tempos de pandemia. Para atingi-lo, pretende-seabordar aspectos gerais relativos ao feminicídio, apresentando conceito, tipologia e caracterização desse novo tipo penal, destacando-se, também, as tratativas a ele conferidas pelo legislador no Código Penal Brasileiro; relatar aspectos referentes à violência contra a mulher no Brasil; analisar a efetividade da qualificadora do feminicídio à luz da teoria do Direito Penal Simbólico. A questão-problema elaborada para ser respondida é a seguinte: quais os índices sobre a violência física e psicológica contra a mulher durante a pandemia da Covid-19 no Brasil? A metodologia adotada na investigação permite classificar a pesquisa como bibliográfica, com análise dos dados do tipo crítica de conteúdo. A abordagem do problema é qualitativa, e a pesquisa, quanto aos fins, pode ser caracterizada como exploratória. Os resultados obtidos demonstraram que as mudanças promovidas pela pandemia na rotina das famílias, com perda de empregos e isolamento, somente fez piorar as estatísticas sobre a violência física e psicológica contra a mulher, sendo que o tipo de ofensa mais recorrente no período foi a verbal (18,6%), com xingamentos, ofensas e insultos. Os dados estatísticos demonstraram também que, nos anos de 2020 e 2021, 4,3 milhões de mulheres (6,3%) foram agredidas fisicamente com socos, tapas ou chutes, o que quer dizer que, a cada minuto, 8 mulheres sofreram violência física no Brasil durante a pandemia do novo coronavírus. Em relação aos agressores, 72,8% são conhecidos das mulheres, a maioria (25,4%) cônjuge, companheiro ou namorado, seguindo-se por ex-cônjuges, companheiros ou namorados (18,1%), pais e mães (11,2%), padrastos e madrastas (4,9%), e filhos/filhas (4,4%). Em relação ao local em que a violência foi perpetrada, o lar apareceu como o mais recorrente (48,8%), seguindo-se pela rua (19.9%) e local de trabalho (9,4%). Diante disso, pode-se concluir que, durante a pandemia da Covid-19, os índices de violência física e psicológica contra a mulher aumentaram, com níveis expressivos. Os fatores que mais agravaram esta conduta, majoritariamente cometida em suas próprias casas, por seus cônjuges, companheiros ou namorados, foi o isolamento social e questões econômico-financeiras, decorrentes da perda do emprego com a crise sanitária que se instalou no país.

Abstract:
The general objective of this article is to investigate data on physical and psychological violence against women in times of a pandemic. To achieve it, we intend to approach general aspects related to femicide, presenting the concept, typology and characterization of this new criminal type, also highlighting the treatments given to it by the legislator in the Brazilian Penal Code; report aspects related to violence against women in Brazil; to analyze the effectiveness of the femicidequalifier in the light of the theory of Symbolic Criminal Law. The problem question designed to be answered is the following: what are the rates of physical and psychological violence against women during the Covid-19 pandemic in Brazil? The methodology adopted in the investigation allows classifying the research as bibliographic, with data analysis of the critical type of content. The approach to the problem is qualitative, and the research, in terms of ends, can be characterized as exploratory. The results obtained showed that the changes promoted by the pandemic in the routine of families, with loss of jobs and isolation, only made the statistics on physical and psychological violence against women worse, with the most recurrent type of offense in the period being verbal (18.6%), with cursing, insults and insults. Statistical data also showed that, in the years 2020 and 2021, 4.3 million women (6.3%) were physically attacked with punches, slaps or kicks, which means that, every minute, 8 women suffered violence. physical activity in Brazil during the new coronavirus pandemic. Regarding the aggressors, 72.8% are known to women, most (25.4%) are spouses, partners or boyfriends, followed by ex-spouses, partners or boyfriends (18.1%), fathers and mothers (11.2%), stepfathers and stepmothers (4.9%), and sons/daughters (4.4%). Regarding the place where the violence was perpetrated, the home appeared as the most recurrent (48.8%), followed by the street (19.9%) and the workplace (9.4%). In view of this, it can be concluded that, during the Covid-19 pandemic, the rates of physical and psychological violence against women increased, with expressive levels. The factors that most aggravated this behavior, mostly committed in their own homes, by their spouses, partners or boyfriends, were social isolation and economic-financial issues, resulting from the loss of employment with the health crisis that took hold in the country.
