TRIBUNAL PENAL INTERNACIONAL PARA NOVAS MODALIDADES CRIMINOSAS: UMA ANÁLISE DO CYBERATQUE HAVIDO NA GEÓRGIA
O presente artigo busca, em apertada síntese, explorar o surgimento do Direito Digital, não como uma nova modalidade do Direito, mas como uma adaptação das doutrinas já existentes para o âmbito virtual. Nesta seara, versa-se sobre o surgimento de um novo tipo de sociedade focada na Internet, cuja ferramenta se estabelece como principal meio de comunicação, mas que, em má utilização é capaz de inferir grandes dados. Nesta toada, surge a aplicabilidade do Tribunal Penal Internacional, que em sua jurisdição transnacional, destaca-se como uma corte especial ao se tratar de crimes que rompem as barreiras físicas. A exemplo de sua utilidade, em conformidade com a utilização da Internet, como foco na sociedade digital e os princípios que moldam desde o início destas, tem-se o caso ocorrido na Geórgia, que se trata de um audacioso ataque russo ao território virtual americano.

Abstract:
This article seeks, in a tight synthesis, to explore the emergence of Digital Law, not as a new modality of Law, but as an adaptation of existing doctrines to the virtual sphere. In this area, it is about the emergence of a new type of society focused on the Internet, whose tool is established as the main means of communication, but which, in misuse, is capable of inferring big data. In this tone, the applicability of the International Criminal Court arises, which in its transnational jurisdiction stands out as a special court when dealing with crimes that break physical barriers. As an example of its usefulness, in accordance with the use of the Internet, as a focus on the digital society and the principles that have shaped it since the beginning of these, there has been the case in Georgia, which is an audacious Russian attack on American virtual territory.
