• Abstract:

  The objective of this study was

  to evaluate the actions taken by the municipal

  public administration of Cascavel to effectively

  comply with the Law on Access to Information

  - LAI (Law 12,527 / 2011), regarding active and

  passive transparency, under the Contingency

  Theory approach. With regard to the typology of

  study, it is classified as descriptive, case-study

  and qualitative. As a research instrument, the

  choice of semi-structured interview was chosen.

  In addition, the LAI Social Questionnaire (TCE

  / PR, 2014) published by this Court was used

  as a basis. It was identified that the municipality

  of Cascavel has not been sufficiently fulfilling

  the law, according to the LAI ranking (TCE /

  PR, 2014), it is classified in the 35th position,

  of a sample of 69 municipalities, that aimed

  to evaluate the degree of Active and passive

  transparency, achieving a percentage of

  transparency of 28.02%, which can be 

  considered deficient. The Contingency Theory was used to observe its influence in

  the implementation of LAI. It was observed that the contingency factors, strategy and

  technology, are more evident in the development of the law. However, it is necessary

  to observe the reality of each municipality, seeking a balance between variables, but

  should be aware of the variables technology and strategy, which are fundamental to the

  implementation of LAI.
