Teoria Jurídica Institucional: um olhar sobre a governança dos comuns
O propósito deste trabalho é trazer o olhar da Teoria Jurídica Institucional para o estudo dos bens comuns. Propõem-se demonstrar que, a partir de alguns ajustes, a visão jurídica institucionalista se mostra compatível e capaz de agregar valor à abordagem dos Sistemas Sócio-Ecológicos proposta por Elinor Ostrom. Desta forma, o presente artigo considera as contribuições trazidas pelo Institucional Analysis and Development (IAD) e o Social-Ecological System (SES) ao passo em que se afasta da teoria convencional dos bens comuns.

Abstract:
The object of this study is presenting the perspective of Institutional Legal Theory to the study of commons. It is proposed to demonstrate, through some adjustments, that the institutionalist legal vision proves compatible and capable of increase value to the Socio-Ecological Systems approach proposed by Elinor Ostrom. Therefore, this article considers the contributions from Institutional Analysis and Development (IAD) and Social-Ecological System (SES) while moving away from the conventional theory of commons.
