Abstract: This article analyzes the civil liability of the Brazilian State in cases of military deaths occurring during service, based on the theory of administrative risk. It examines relevant national doctrine and case law, highlighting the positions of the Federal Supreme Court (STF) and the Superior Court of Justice (STJ), while also drawing comparisons with international experiences—particularly Israel’s compensation policies for fallen soldiers. The study advocates for the institutionalization of swift and effective reparatory measures to ensure justice and legal certainty for the families of deceased service members.
