RESPONSABILIDADE ADMINISTRATIVA E PANDEMIA: UM BREVE ESTUDO SOBRE OS LIMITES DA DISCRICIONARIEDADE E DO NEGACIONISMO
O presente trabalho tratou da gestão da pandemia, com foco na atuação do Presidente do Brasil Jair Messias Bolsonaro. O objetivo central do trabalho foi analisar em que medida a política negacionista adotada pelo Chefe do Poder Executivo Federal influenciou no alto índice de mortes no Brasil durante o ano 1 da pandemia do novo coronavírus. Adotou-se como metodologia de pesquisa o método de abordagem indutiva e o método de procedimento de análise de jurisprudência do Supremo Tribunal Federal (STF) e análise do discurso público empregado pelo Presidente Jair Bolsonaro durante o primeiro ano da pandemia. Verifica-se que há indícios que o Presidente Bolsonaro atuou de forma omissiva no enfrentamento do novo coronavírus em território brasileiro sem observar os limites do poder discricionário, visto que adotou uma postura negacionista quanto à gravidade do vírus e não observou as normas e critérios científicos e técnicos definidos pelas organizações de saúde.

Abstract:
The present work dealt with the management of the pandemic, focusing on the role of the President of Brazil Jair Messias Bolsonaro. The main objective of the study was to analyze to what extent the denial policy adopted by the Head of the Federal Executive Power influenced the high rate of deaths in Brazil during year 1 of the new coronavirus pandemic. The research methodology adopted was the inductive approach method and the Supreme Court (STF) jurisprudence analysis procedure method and analysis of the public discourse used by President Jair Bolsonaro during the first year of the pandemic. It appears that there is evidence that President Bolsonaro acted negligently in dealing with the new coronavirus in Brazilian territory without observing the limits of discretionary power, since he adopted a denial stance regarding the severity of the virus and did not observe the scientific norms and criteria and technicians defined by health organizations.
