PROPOSTA DE CRIAÇÃO DE RPPN PARA SALVAGUARDO DE PATRIMÔNIO ESPELEOLÓGICO – LAPA DA FORQUILHA, BALDIM - MG
A cavidade Lapa da Forquilha incluise dentre as grandes descobertas realizadas
por Peter Lund no Brasil. O simples fato
desta se configurar como parte dos achados
de Lund agrega significativo valor históricocultural à mesma aumentando a necessidade
de sua preservação. Há leis que garantem a
integridade física da caverna, porém, ao instituir
uma Reserva Particular do Patrimônio Natural
(RPPN) na área do entorno da caverna, é possível
proporcionar maior proteção e recursos para sua
manutenção e preservação. Ao se tombar uma
área em RPPN é importante, principalmente
para o proprietário, a realização de uma análise
de viabilidade, uma vez que este deverá, além
de ceder parte de seu terreno em caráter
perpétuo, se responsabilizar pela manutenção
e preservação da Unidade de Conservação
(UC) estabelecida em sua propriedade. Este
estudo permite averiguar se a cavidade possui
atributos relevantes que justifiquem a criação
de uma UC para garantir sua preservação e
se não trará prejuízos ao proprietário, uma vez
que o mesmo poderá responder legalmente por
qualquer impacto ocorrido na área. A análise
ambiental de viabilidade foi realizada através
de estudo de relevância da cavidade e por
criterioso exame nas legislações pertinentes. O
diagnóstico ambiental permitiu a identificação
de áreas passíveis de recuperação. Ao
examinar a legislação conheceu-se os direitos
e obrigações em relação ao proprietário da
fazenda. O presente estudo permitiu evidenciar
que a viabilidade na criação de uma RPPN
está diretamente ligada aos interesses do
proprietário e das particularidades do uso e
ocupação do solo no terreno.

Abstract:
The cave calls “Lapa da Forquilha” is included among the great discoveries made by Peter Lund in Brazil.
Only the fact that this cave is part of the Lund findings adds significant historical and
cultural value, aggravating the preservation needs. There are laws that guarantee
the physical integrity of the cave, however, establishing a Private Natural Patrimony
Reserve in the surrounding area of the cave, it is possible to provide greater protection
and resources for its maintenance and preservation. When you create an area in
Private Natural Patrimony Reserve is of utmost importance, especially to the owner,
to conduct a viability analysis, since this should, in addition to giving up part of their
land in perpetuity, the owner will be responsible for the maintenance and preservation
of the Conservation Unit established on your property. This study allows determine if
the cavity has important attributes that justify the creation of a Conservation Unit to
ensure its preservation. The environmental viability analysis was carried out through a
study of the relevance and by a examination of the relevant laws. The environmental
analysis allowed the identification of areas for recovery. By examining the legislation
was possible to know the rights and obligations in relation to the owner of the farm.
This study provided insight into the viability in creating a Private Natural Patrimony
Reserve is directly linked to the interests of the owner and the particularities of the use
and occupation of soil/ground.
