PERÍCIA FONOAUDIOLÓGICA NO ÂMBITO JUDICIAL: DA INTIMAÇÃO À ENTREGA DO LAUDO
O presente guia tem por objetivo trazer orientações teóricas ao fonoaudiólogo que pretende atuar como perito judicial ou como assistente técnico sobre as condutas necessárias e os procedimentos adequados para exercer essas funções. São esclarecidos os passos desde o momento em que o profissional é intimado pelo juízo para a perícia, passando pelo estudo do caso, o aceite, o pedido de arbitramento dos honorários periciais, o agendamento das diligências, a avaliação pericial, a entrega do laudo e, por fim, o recebimento dos honorários. São também apresentados e esclarecidos os diversos dispositivos legais atinentes à atuação em âmbito judiciário. Ao final, aborda-se o contexto da Audiologia Ocupacional. São explicados e exemplificados os cálculos da avaliação audiométrica constantes na Norma Regulamentadora do trabalho número 7 para desencadeamento e agravamento da PAINPSE, das medidas de atenuação de um EPA - cálculo simples e longo - considerando o laudo de ruído ambiental, que é o agente nocivo mais comum e danoso aos trabalhadores.

Abstract:
The purpose of this manual is to provide theoretical guidance to the speech-language pathologist, who wants to work as an expert witness or as a party appointed expert, about the necessary conditions and the appropriate procedures for these functions. Every step are clarified here, from the moment that the professional is designed by the judge to start the inspections, the moment of the study of the case, the acceptance, the request for arbitration of the expert fees, the scheduling of the diligences, the expert evaluations, the report's deposit, and finally, the receipt of the fees. There are also explained and clarified the various legal provisions related to the performance in the judicial sphere. Finally, the context of Occupational Audiology is approached. There are explained and exemplified the calculations of the audiometric evaluation contained in the Brazilian Work Regulatory Norm number 7 for triggering and worsening of the PAINPSE, and about of the mitigation measurements of an EPA - simple and long calculation, considering the report of environmental noise, which is the most common and harmful factor to workers.
