Pelo direito das mulheres a uma vida livre de violência: a influência dos direitos humanos na legislação brasileira
Por longo tempo, as mulheres ocuparam papel secundário na vida civil, como mera expectadora dos homens. Por isso, a violência por elas sofrida era naturalizada e invisibilizada pela sociedade, tida como problema familiar do qual não cabia intervenção de terceiros. Nessa esteira, esta pesquisa investiga como o sistema universal de proteção dos direitos humanos das mulheres influenciou o direito brasileiro, na busca pela igualdade material de gênero e quais os desafios para tanto. Com esse fim, utiliza-se o método científico dedutivo, a partir da revisão bibliográfica da legislação estrangeira, nacional e teorias relativas ao tema. Conclui-se que a legislação doméstica foi fortemente influenciada pelo sistema universal de direitos humanos das mulheres, mediante a criação de legislação que visa assegurar a igualdade material e com a revogação de dispositivos legais discriminatórios vigentes até o início do século. Por outro lado, verificou-se a necessidade de efetivar o cumprimento das recomendações e tratados de direito internacional, além de implementar ações políticas integradas no âmbito público e privado das relações que sejam capazes de corrigir as desigualdades com discriminações positivas, e enraizar uma cultura de respeito aos direitos humanos das mulheres.

Abstract:
For a long time, women played a secondary role in civil life, as a mere spectator of men. For this reason, the violence they suffered was naturalized and made invisible by society, seen as a family problem that could not be dealt with by third parties. In this context, this research investigates how the universal system for the protection of women's human rights has influenced Brazilian law, in the search for material gender equality, and what the challenges are for that. To this end, the deductive scientific method is used, based on a bibliographic review of foreign and national legislation and theories related to the theme. It is concluded that domestic legislation was strongly influenced by the universal system of women's human rights, through the creation of legislation that aims to ensure material equality, and with the repeal of discriminatory legal provisions in force until the beginning of the century. On the other hand, there was a need to enforce the recommendations and treaties of international law, in addition to implementing integrated political actions in the public and private sphere of relations that are capable of correcting inequalities with positive discrimination and rooting a culture of respect for women's human rights.
