OS DESDOBRAMENTOS PROVENIENTES DA PRÁTICA DO CARTEL: UMA ANÁLISE À LUZ DA RESPONSABILIDADE CIVIL
O conteúdo abordado tem como fundamento precípuo analisar os efeitos causados pelos cartéis no ordenamento econômico pátrio à luz da responsabilidade civil, haja vista a persistência de discussões acerca dos aspectos concernentes a tais desdobramentos no âmbito jurídico hodierno. Nessa perspectiva, o presente artigo procedeu de modo a verificar a evolução dos acordos financeiros que possuem o escopo de permanecer em um determinado sistema econômico mediante aferimento de lucros e monopolização, os quais maculam consideravelmente o direito concorrencial e, por consequência, o do consumidor, por meio de pesquisa exploratória, utilizando-se do método dedutivo e da coleta de dados documentais e bibliográficos. Não obstante, elucidou, também, os efeitos causados pelo cartel no âmbito da responsabilidade civil, por intermédio da verificação de prejuízos. Por fim, diante da problemática exposta, buscou-se, com fundamento nos dispositivos legais vigentes, traçar mecanismos capazes de assegurar a limitação das práticas cartelistas, por meio de novas políticas que tratem essas atuações com destreza, com vistas a garantir a segurança jurídica da ordem social.

Abstract:
The content discussed is primarily based on analyzing the effects caused by cartels in the national economic order in the light of civil liability, given the persistence, in today's legal sphere, of discussions about aspects related to such developments. In this perspective, this article proceeded in order to verify the evolution of financial agreements that have the scope to remain in a given economic system through the measurement of profits and monopolization, which considerably taint the competition law and, consequently, the consumer, through exploratory research, using the deductive method and the collection of documentary and bibliographic data. Nevertheless, it also elucidated the effects caused by the cartel in the scope of civil liability, through the verification of losses. Finally, in view of the exposed problem, an attempt was made, based on the current legal provisions, to outline mechanisms capable of ensuring the limitation of cartelist practices, through new policies that deal with these actions with dexterity, in order to guaranteeing the legal security of the company. social order.
