OS DESAFIOS DA REPATRIAÇÃO DE BENS PATRIMONIAIS: UMA DISPUTA NO CAMPO DA POLÍTICA INTERNACIONAL /// THE CHALLENGES OF REPATRIATION OF PATRIMONIAL PROPERTY: A DISPUTE IN THE FIELD OF INTERNATIONAL POLICY
A influência do patrimônio histórico e cultural sobre a dinâmica organizacional dos povos, a partir da construção de elos identitários e da memória coletiva, torna pertinente a reflexão sobre como a manutenção da posse e a recusa pela devolução de peças históricas ferem a soberania e a autodeterminação dos povos, refletindo as assimetrias do Sistema Internacional e remetendo a um passado de dominação. Um movimento internacional de requerimento da restituição de bens patrimoniais escamoteados encontra barreiras numa tendência discursiva com fins justificativos por parte dos detentores: a suposta incapacidade dos requerentes de salvaguardar o próprio patrimônio. O apelo a uma nova percepção dos espaços no sistema internacional globalizado, com a invocação do “patrimônio mundial” contribui para a relativização discursiva das demandas crescentes de restituição (coordenadas numa ação multilateral nos fóruns internacionais) e se relaciona com uma defesa da manutenção do status quo.

Abstract:
The influence of historical and cultural patrimony on the organizational dynamics of people, starting with the construction of identity links and collective memory, makes pertinent the reflection about how the maintenance of the possession and the refusal to return historical pieces damage sovereignty and self-determination of the people, reflecting the asymmetries of the International System and referring to a past of domination. An international movement for petition for the refund of retrenched assets finds barriers in a discursive tendency with justifying purposes on the part of the holders: the supposed inability of the applicants to safeguard their own assets. The call for a new perception of spaces in the globalized international system, with the invocation of "world heritage" contributes to the discursive relativization of the increasing demands of restitution (coordinated in a multilateral action in the international forums) and relates to a defense of the maintenance of the status quo.
