OPERAÇÃO EXCEPTIS: UM ESTUDO DE CASO CONTEMPLANDO ANÁLISE DO MODELO DE INVESTIGAÇÃO CRIMINAL E ADOÇÃO DE BOAS PRÁTICAS PROCEDIMENTAIS
Gostaríamos de iniciar a discussão do assunto colocando em evidência um caso prático que foi a operação policial chamada de “Exceptis” pela Polícia Civil, coordenada pela Delegacia de Proteção à Criança e ao Adolescente (DPCA) e que resultou na morte de 28 pessoas incluindo um policial civil no morro do Jacarezinho1, Rio de Janeiro.
O assunto ganhou os noticiários da mídia divulgando-se, em amplo e bom som, que foi uma ação truculenta do Estado, suscitando inclusive ataques de organismos internacionais onde levantou-se a indagação sobre qual o modelo de manutenção da ordem era aplicado nas favelas? O fato agravou-se ainda mais pela existência de decisão do Ministro Luiz Edson Fachin do STF, que, em ação movida pelo Partido Socialista Brasileiro (PSB), em novembro de 2019, impedia ações policiais em morros, visando, segundo entendimento sustentado, salvaguardar a integridade física dos moradores da favela dos perigos de um possível confronto armado.

Abstract:
We would like to start discussing the matter by highlighting a practical case which was the police operation called “Exceptis” by the Civil Police, coordinated by the Police for the Protection of Children and Adolescents (DPCA) and which resulted in the death of 28 people, including one civil police officer in the hill of Jacarezinho1, Rio de Janeiro.
The subject won the news in the media, publicizing, in wide and clear sound, that it was a truculent action by the State, even prompting attacks by international organizations where the question was raised about which model of order maintenance was applied in the favelas? The fact was further aggravated by the existence of the decision of Minister Luiz Edson Fachin of the STF, which, in a lawsuit filed by the Brazilian Socialist Party (PSB), in November 2019, prevented police actions in hills, aiming, according to sustained understanding, to safeguard the physical integrity of favela residents from the dangers of a possible armed confrontation. -
