O PREQUESTIONAMENTO COMO REQUISITO DE ADMISSIBILIDADE DO RECURSO ESPECIAL
O presente trabalho trata do prequestionamento como filtro recursal e requisito de admissibilidade do recurso especial. Após elencar os requisitos comuns de admissibilidade dos recursos, aborda-se o requisito do prequestionamento, o qual exige o questionamento ou enfrentamento pelo tribunal recorrido no acórdão impugnado que é objeto do recurso excepcional, sob pena de não conhecimento do recurso especial. Também, identifica-se o entendimento do Superior Tribunal de Justiça quanto ao prequestionamento implícito e a previsão legal do instituto no Código de Processo Civil, que buscou diminuir o formalismo exigido pelo tribunal superior. Por fim, busca demonstrar o entendimento atual sobre o tema por meio de jurisprudência.

Abstract:
This paper is about the previus questioning as an appeal filter and the admissibility requirement of the special appeal. After listing the common requirements for admissibility of appeals, the prequestioning requirement is addressed, which requires questioning or confrontation by the appellate court in the contested judgment that is the subject of the exceptional appeal, under penalty of not knowing the special appeal. Also, the Superior Court of Justice's understanding of the implicit pre-questioning and the legal provision of the institute in the Code of Civil Procedure, which sought to reduce the formalism required by the higher court, is identified. Finally, it seeks to demonstrate the current understanding of the topic through jurisprudence.
