O crescente fluxo migratório forçado

tem tomado proporções alarmantes e atraído a

atenção dos Estados, impelindo-os a lidar com a

temática do refúgio. Diante disso, surgem novas

questões a ser enfrentadas, dentre as quais a

necessidade de conceder proteção adequada

aos refugiados pelos Estados acolhedores, que

se reveste de caráter jurídico, não apenas pela

própria natureza do status a eles concedido, mas

também pelos direitos assegurados nacional e

internacionalmente. Nesse cenário, o presente

artigo pretende analisar a garantia processual

de acesso à justiça para os refugiados e

requerentes de refúgio no Brasil como o principal

dos direitos do ser humano, investigando

os obstáculos normativos, estruturais e

institucionais cotidianamente enfrentados pelos

refugiados e solicitantes de refúgio ao buscar

acesso aos direitos legalmente assegurados,

com o fim de proporcionar substrato teórico

para o aperfeiçoamento das políticas públicas

direcionadas à população refugiada e conferir

uma proteção integral e efetiva a esse público.

Abstract:
The increasing flow of forced

migration has taken on alarming proportions and,

consequently, attracted the attention of States,

impelling them to deal with refugee issues. As

a result, there are new issues to be addressed,

among which the need to provide refugee

refugees with adequate protection, which is

of a legal nature, not only because of the very

nature of the status granted to them, but also

rights guaranteed nationally and internationally.

In view of this scenario, a procedural guarantee of access to justice for refugees and asylum-seekers in Brazil as the main human

rights will be analyzed, investigating obstacles normative, structural and institutional

problems faced by refugees and asylum-seekers in seeking access to legally secured

rights, in order to provide a theoretical basis for the improvement of public policies

aimed at the refugee population, with a view to granting a full and effective protection

to those refugees.
