Abstract: The Amazon, at the epicenter of debates on the climate crisis, harbors vast socio-biodiversity that faces existential threats. Although Brazil possesses one of the world’s most advanced environmental legal frameworks, its practical effects in protecting traditional communities—Indigenous peoples, riverine populations, and quilombolas—remain notably limited. This chapter examines the dissonance between legal norms and lived reality, arguing that the failure to implement public policies and ensure effective enforcement constitutes a framework of climate injustice. Through bibliographic and documentary analysis, with emphasis on emblematic cases such as the Belo Monte Hydroelectric Plant, the Yanomami humanitarian crisis, and persistent land conflicts, it is demonstrated that the vulnerability of these populations is exacerbated by state omission. The study concludes that the effective implementation of Environmental Law is the central challenge to securing a sustainable and socially just future in the region.
