Abstract: The amparo for disappeared persons in Mexico is a new legal tool of protection against forced disappearance and state omission. Its immediate background lies in the evolution of the writ of amparo, established in the 1917 Constitution as a means of defending fundamental rights. Following the 2011 human rights reforms and the 2013 Amparo Law, its scope of application was expanded, allowing relatives, organizations, or human rights advocates to file amparos on behalf of disappeared persons. This process does not guarantee that the missing person will be found; however, it does require state authorities to activate all available search mechanisms. In doing so, it raises awareness of the issue and has also provided victims’ families with greater trust in the Mexican legal system.
