"IMPOTÊNCIA” DO PODER DE RESPONSABILIZAR!?!: DINÂMICAS DO PODER LEGISLATIVO NO EXERCÍCIO DA SUA FUNÇÃO DE FISCALIZAÇÃO LEGISLATIVA SOBRE O ORÇAMENTO E CONTAS PÚBLICAS EM MOÇAMBIQUE
RESUMO: O Poder Legislativo constitui um dos mais importantes poderes de um determinado Estado. As suas funções resumem-se em três (3) nomeadamente: a representação, legislar e a de fiscalização. A importância deste poder [de entre os três poderes: Executivo, Judicial e Legislativo] vislumbra-se como crucial num determinado Estado na medida em que é o único com função constitucional capaz de garantir a fiscalização da acção do Poder Executivo, bem como, a respectiva responsabilização pelas suas acções. No âmbito da sua função de fiscalização, cabe ao Poder Legislativo, escrutinar e fiscalizar a alocação e a gestão de recursos públicos de um determinado Estado. Neste sentido, o escrutínio e a fiscalização legislativa sobre o orçamento e contas públicas constituem um dos mecanismos mais importantes para garantir o controlo e a responsabilização da acção do Executivo no que tange a gestão dos recursos públicos, as finanças públicas.

Abstract:
ABSTRACT: The Legislature is one of the most important powers of the State. Its functions can be summarized in three (3) namely: representation, legislation, and oversight. The importance of this power [among the three powers: Executive, Judicial and Legislative] is seen as crucial in a given State insofar as it is the only one with a constitutional mandate capable to guarantee the oversight and accountability of the Executive. Within the scope of its oversight function, it is up to the Legislature to scrutinize and oversight the allocation and management of public resources in a given State. In this sense, the scrutiny and legislative oversight of the budget and public accounts constitute one of the most important mechanisms to guarantee the control and accountability of the Executive's action regarding the management of public resources and/or public finances.
