IDENTIFICAÇÃO DOS INSTRUMENTOS LEGAIS DE POLÍTICAS PÚBLICAS AMBIENTAIS APLICÁVEIS NA GESTÃO AMBIENTAL DAS ÁREA DE PROTEÇÃO PERMANENTE

Este texto tem como objetivo identificar os principais instrumentos legais de políticas públicas ambientais que orientam a gestão das Áreas de Preservação Permanente (APPs) no Brasil, destacando sua evolução normativa e implicações práticas, especialmente no contexto urbano. A pesquisa adota metodologia documental, com base em análise de legislação federal, estadual e municipal, além de resoluções do CONAMA e do Código Florestal. O trabalho percorre a trajetória normativa das APPs desde o Código Florestal de 1934, passando pelas reformulações de 1965, 1989 e 2012, até a recente Lei nº 14.285/2021, que descentraliza a regulamentação das APPs urbanas para os municípios. Conclui-se que há avanços importantes no arcabouço legal, mas persistem dificuldades na efetiva proteção das APPs, demandando maior articulação entre os entes federativos e fortalecimento da gestão ambiental local.

  • Abstract: This paper aims to identify the main legal instruments of environmental public policies that guide the management of Permanent Preservation Areas (PPAs) in Brazil, highlighting their normative evolution and practical implications, especially in the urban context. The research adopts a documentary methodology, based on an analysis of federal, state, and municipal legislation, as well as CONAMA resolutions and the Forest Code. The work covers the regulatory trajectory of PPAs from the 1934 Forest Code, through the reformulations of 1965, 1989, and 2012, to the recent Law No. 14,285/2021, which decentralizes the regulation of urban PPAs to municipalities. The conclusion is that there have been significant advances in the legal framework, but difficulties persist in effectively protecting PPAs, requiring greater coordination among federal entities and strengthening local environmental management.
