Abstract: This article is the result of a course conclusion work, presented to the University of Passo Fundo (UPF) course, to complement the Bachelor's degree in Legal and Social Sciences. In the work in question, an analysis was carried out, linked to an empirical research, on the situation of the transgender person - discordant in relation to the binary structure of gender - in the formal labor market in the city of Passo Fundo, Rio Grande do Sul (Brazil), identifying the main ones Verified by this minority population segment to participate in productive processes in the organizational market of the municipality. Considering the specificities that guide the access to an article, it was opted for a work in an ensa tone, from the elaboration of works, in order to provide studies on specific elements founding the structural exclusion of non-bibliographic non-bibliographic people from the labor market in Brazil, and what is the role to ensure to these solutions their citizenship and especially their application in work environments, with freedom of the State and freedom.
