“GOVERNANÇA NA PREVENÇÃO E RESPOSTA AOS DESASTRES AMBIENTAIS: UMA ANÁLISE A PARTIR DE MARIANA E BRUMADINHO
O objetivo da presente pesquisa é analisar os instrumentos normativos atinentes ao tema dos desastres ambientais no Brasil, mesmo considerado o direito dos desastres incipiente no país se comparado a outras nações. Demonstra-se, ao final, que existem leis e princípios suficientes para a prevenção de danos e sua reparação, basta que sejam observados e cumpridos. O método utilizado para a pesquisa é o indutivo, pois avalia aspectos do direito desastres, aborda as fases preventiva e responsiva, finalizando com a análise de dois casos concretos, que são o rompimento das barragens de Mariana e Brumadinho.

Abstract:
The objective of this research is to analyze the normative instruments related to the theme of environmental disasters in Brazil, even considering the incipient law of disasters in the country when compared to other nations. In the end, it is demonstrated that there are sufficient laws and principles for the prevention of damage and its repair, it is enough that they are observed and complied with. The method used for the research is the inductive one, as it assesses aspects of disaster law, addresses the preventive and responsive phases, ending with the analysis of two concrete cases, which are the rupture of the Mariana and Brumadinho dams.
