A contratação pela Administração

Pública, por meio da terceirização de empresas

privadas ou organizações da iniciativa privada,

sem fins lucrativos e que prestam serviços de

caráter público, traz algumas dificuldades no

que tange a gestão e a fiscalização na execução

dos contratos celebrados entre as partes, seja

por falta de pessoal, por negligência ou por

falta de capacitação das figuras centrais desse

processo, o gestor e o fiscal. Nesse sentido,

objetiva-se neste trabalho analisar as rotinas

administravas adotas na Gestão e Fiscalização

dos Contratos Administrativos celebrados pelo

Instituto Federal do Maranhão (IFMA) Campus

Presidente Dutra e especificamente, verificar se

estão condizentes com a Instrução Normativa nº

05, de 25 de maio de 2017, utilizando a pesquisa

descritiva com abordagem qualitativa, devido

sua relevância e entendendo sua profundidade.

Diante disso, o estudo identificou a metodologia,

rotinas administrativas, instrumentos e falhas

na fiscalização dos contratos.

Abstract:
The contracting by the Public

Administration, through the outsourcing of

private companies or organizations of the

private initiative, non-profit and that provide

services of public character, presents some

difficulties regarding the management and the

supervision in the execution of the agreements

entered into between the parties, due to lack of

personnel, negligence or lack of training of the

central figures of this process, the manager and

the supervisor. In this sense, the objective of this

work is to analyze the administrative routines

adopted in the Management and Supervision

of Administrative Contracts concluded by the

Federal Instituto do Maranhão (IFMA) Campus

Presidente Dutra and specifically, to verify if they

are consistent with Normative Instruction No. 05,

of May 25 of 2017, using descriptive research

with a qualitative approach, even though the

proposed theme is not innovative, however, it is

necessary to understand its essence. Given this, the study identified the methodology,

administrative routines, instruments and failures in the control of contracts.
