Abstract: This article analyzes education within the Brazilian prison system as a fundamental human right and as a public policy essential to the promotion of citizenship, social justice, and the social reintegration of incarcerated individuals. It employs a bibliographic methodology with a qualitative approach, as well as document analysis grounded in national legal frameworks such as the 1988 Federal Constitution, the Penal Execution Law, and the National Education Plan—and international human rights treaties. The study discusses the implementation of prison education and the persistent challenges in its execution. The text also draws on the principles of Paulo Freire’s critical pedagogy, highlighting education as a practice of freedom and a tool for the emancipation of historically marginalized subjects. Additionally, it addresses the concepts of transversality and intersectorality as key strategies for a broader educational approach that integrates various public policies and acknowledges the complexity of inmates’ life trajectories. The article demonstrates how social exclusion—before, during, and after incarceration—is both a cause and a consequence of the precariousness of prison education. It concludes that ensuring this right requires not only compliance with current legislation but also a political, ethical, and pedagogical commitment to a transformative, critical, and inclusive education.
