DIREITO E EDUCAÇÃO INFANTIL: UMA ABORDAGEM INTERDISCIPLINAR
A educação infantil é relevante ao desenvolvimento humano, pois estabelece as bases para as aprendizagens das crianças. A Constituição de 1988 inovou na tratativa da educação, estabelecendo direitos e diretrizes. Entretanto, quanto à educação infantil, nota-se uma reiterada falha prestacional, vez que o Estado não disponibiliza vagas a todos os titulares do direito. Notável tem sido a busca pela efetivação deste direito através de intervenções judiciais. Este trabalho objetiva analisar a intervenção do Poder Judiciário e do Ministério Público para a disponibilização de vagas em educação infantil na cidade de Dois Vizinhos – PR. Para realizar esta pesquisa utilizou-se o método de análise dedutivo, com objetivo exploratório e técnicas de documentação indireta. A partir dos dados consultados foi possível observar que a população assumiu protagonismo face ao direito à educação infantil, que provocar a jurisdição é eficaz na garantia da vaga em creches e pré-escolas e que as intervenções resultaram em acordo com operacionalização das obrigações municipais.

Abstract:
The early childhood education is relevant to human development as it lays the foundation for children's learning. The 1988 Constitution innovated in dealing with education, establishing rights and guidelines. However, with regard to early childhood education, there is a repeated failure in provision, since the State does not provide vacancies to all right holders. Notable has been the search for the realization of this right through judicial interventions. This work aims to analyze the intervention of the Judiciary and the Public Ministry for the provision of places in early childhood education in the city of Dois Vizinhos – PR. In order to carry out this research, the deductive analysis method was used, with an exploratory objective and indirect documentation techniques. From the data consulted, it was possible to observe that the population assumed a leading role in the right to early childhood education, that provoking jurisdiction is effective in guaranteeing a place in daycare centers and pre-schools and that the interventions resulted in an agreement with the operationalization of municipal obligations.
