DIREITO AMBIENTAL E AGRICULTURA: UM ESTUDO SOBRE AGROTÓXICOS E PRÁTICAS ALTERNATIVAS
O presente artigo busca estudar alternativas ao uso de agrotóxicos convencionais, de forma a melhor resguardar, principalmente, o direito fundamental ao meio ambiente ecologicamente equilibrado e o direito à saúde, ambos previstos pela Constituição Federal de 1988. Através do método hipotético-dedutivo, o objetivo da pesquisa foi contribuir à seguinte reflexão: "Há alternativas viáveis ao uso de agrotóxicos atualmente?”, tendo em vista a crescente onda de liberações de agrotóxicos no Brasil desde 2016 - que, em 2021, bateu novo recorde, alcançando a marca de 499 registros aprovados ao longo do ano. Portanto, considerando os impactos causados principalmente ao meio ambiente e à saúde - tanto do consumidor final de alimentos tratados com agrotóxicos quanto do trabalhador rural envolvido na produção destes -, comprovados por robustos estudos científicos dentro e fora do território nacional, o estudo dos agrotóxicos e a busca por alternativas a partir da ótica jurídica mostra-se coerente e necessário.

Abstract:
This article seeks to study alternatives to the use of conventional pesticides in order to better protect, mainly, the fundamental right to an ecologically balanced environment and the fundamental right to health, both provided by the Brazilian Federal Constitution of 1988. Through the hypothetical-deductive method, the main objective of this research was to ponder over the following question: "Are there viable alternatives to the use of pesticides today?", in view of the growing wave of pesticide releases in Brazil since 2016 - which, in 2021, has broken a new record, reaching the mark of 499 approved substances throughout the year. Therefore, considering the impacts caused mainly to the environment and health - both for the final consumer of food treated with pesticides and for the rural worker involved in their production -, proven by robust scientific studies in and outside Brazilian borders, the study of pesticides and the search for alternatives from a legal perspective shows to be coherent and necessary.
