CRISE DEMOCRÁTICA E PANDEMIA: NOVOS RUMOS PARA O CONSTITUCIONALISMO EM TERRAS DEPENDENTES
Este trabalho empreende apresentar um debate acerca da crise democrática que assola o Brasil, trazendo graves prejuízos à população e seus direitos constitucionais, especialmente em tempos de pandemia. Para tanto, servimo-nos das contribuições do estruturalismo latino-americano, engendrado na Comissão Econômica para a América Latina e o Caribe (Cepal), da teoria marxista da dependência e dos apontamentos realizados pela teoria decolonial. Estabelece-se aqui, portanto, um diálogo entre a subalternização econômica e política do Brasil e da América Latina, reiterada pelos processos de colonialidade, e o Direito Constitucional, local privilegiado de proteção dos direitos fundamentais.

Abstract:
This article seeks to present a debate about the democratic crisis that is plaguing Brazil, causing serious damage to the population and their constitutional rights, especially in times of pandemic. To this end, we use the contributions of Latin American structuralism, engendered in the Economic Commission for Latin America and the Caribbean (ECLAC), the marxist theory of dependence and the contributions made by the decolonial theory. Therefore, a dialogue is established between the economic and political subordination of Brazil and Latin America, reiterated by the processes of coloniality, and Constitutional Law, a privileged place for the protection of fundamental rights.
