CRIMES LICITATÓRIOS DURANTE A PANDEMIA DA COVID-19: O AUMENTO DA CORRUPÇÃO EM RAZÃO DAS CAUSAS DE DISPENSA
Considerando que a corrupção é um problema que assola o Brasil, bem como o elevado número de casos de crimes que se tem constatado em decorrência das contratações diretas realizadas durante a pandemia do novo coronavírus, o presente trabalho tem como objetivo analisar os casos atuais de corrupção e os mecanismos para o seu combate. Para isso, utilizou-se do método dedutivo com pesquisa bibliográfica, análise da legislação brasileira e consulta a dados públicos disponibilizados pelo Governo Federal. Assim, o presente estudo perpassou pela análise das regras gerais de contratação pública adotadas no Brasil, a legislação vigente em decorrência da situação pandêmica, bem como os casos de fraudes atuais e possíveis formas de combate à corrupção. Ao final constatou-se que, em que o combate à fraude e à corrupção institucionalizada deve ser feito a partir do trabalho conjunto de todos os Poderes e entes da federação, bem como pela conjugação dos mecanismos de controle preventivos e repressivos.

Abstract:
Considering that corruption is a problem that plagues Brazil, as well as the high number of cases of crimes that have been verified as a result of direct contracts carried out during the pandemic of the new coronavirus, the present work aims to analyze the current cases of corruption and the mechanisms for combating it. To do so, it was used the deductive method with bibliographic research, analysis of Brazilian legislation and consultation of public data provided by the Federal Government. Thus, the present study went through the analysis of the general public procurement rules adopted in Brazil, the current legislation due to the pandemic situation, as well as the cases of current fraud and possible ways of fighting corruption. At the end, it was found that the fight against fraud and institutionalized corruption must be done based on the joint work of all the Powers and entities of the federation, as well as by the combination of preventive and repressive control mechanisms.
