Considerações acerca do Ativismo Judicial
O presente trabalho analisa o fenômeno do ativismo judicial, examinando ainda – embora de forma superficial – questões como o neoconstitucionalismo e a judicialização da política. Será abordada a teoria dos princípios e as críticas contra ela voltadas, a constante busca pela garantia dos direitos fundamentais, além das omissões perpetradas pelo Poder Legislativo e Executivo, que provocam a prática do ativismo judicial – tema principal do trabalho.

Abstract:
This paper analyzes the phenomenon of judicial activism, also examining - albeit superficially - issues such as neoconstitutionalism and the judicialization of politics. The theory of principles and the criticisms against it will be addressed, the constant search for the guarantee of fundamental rights, in addition to the omissions perpetrated by the Legislative and Executive Power, which provoke the practice of judicial activism - the main theme of the work.
