CONHECIMENTOS SOBRE LEGISLAÇÃO EM SAÚDE: UMA FERRAMENTA DA AUDITORIA DE ENFERMAGEM
O processo de auditoria envolve a aplicação de uma série de procedimentos, tendo por objetivo identificar, comprovar e relatar falhas ou desvios de conduta em relação a padrões preestabelecidos para a área sob avaliação. Além disso, cumpre ao auditor a missão de sugerir mudanças para o aprimoramento dos controles-chave do sistema relativo às áreas ou setores objeto de auditoria, contribuindo para que medidas sejam implementadas, por quem de direito, visando otimizar a utilização e a salvaguarda dos recursos financeiros e humanos disponíveis. Para desempenhar essas funções, o auditor deve conhecer profundamente os processos de controle interno e, bem assim, a legislação emanada dos diversos órgãos reguladores, tanto da sua profissão quanto da área ou setor sob auditoria. É nesse contexto que o conhecimento da legislação pertinente à área de saúde adquire importância capital na Auditoria de Enfermagem, eis que cabe ao auditor, nesse caso, zelar para o correto cumprimento dessa legislação. Como se sabe, a legislação brasileira pertinente à saúde é extremamente complexa e, em muitos casos, carente de melhorias. Assim, o presente artigo se concentrará especificamente nas normas legais e infralegais, pertinentes ao Código de Defesa do Consumidor e ao Sistema Nacional de Saúde Suplementar. Em face do exposto, o presente artigo objetivou a realização de um levantamento bibliográfico para construção de uma revisão narrativa, a fim de compilar estudos científicos da área e abordar os principais aspectos relacionados sobre legislação em saúde para obter, compilar e delimitar o campo de conhecimento e atuação do Enfermeiro Auditor, que permita o exercício qualificado de sua profissão. Neste mesmo contexto, a finalidade é discorrer acerca do conceito, objetivos e técnicas utilizadas na condução de uma Auditoria de Enfermagem, além de identificar, compilar e comentar a legislação brasileira que trata do Código de Defesa do Consumidor e do Sistema de Saúde Suplementar, no que se refere, especificamente, à Auditoria de Enfermagem.

Abstract:
The audit process involves the application of a series of procedures, with the objective of identifying, proving and reporting, flaws or deviations in conduct in relation to pre-established standards for the area under evaluation. In addition, the auditor fulfills the mission of suggesting changes to improve the key controls of the system related to the areas or sectors being audited, contributing to measures being implemented, by those entitled, in order to optimize the financial and human resources available. In order to perform these functions, the auditor must have a thorough knowledge of the internal control process, as well as the legislation issued by the various regulatory agencies, both in their profession and in the area or sector under audit. It is in this context that the knowledge of the legislation affects the health area acquires main importance in the Nursing Audit, since it is up to the auditor, in this case, to ensure the correct compliance with this legislation. As is well known, Brazilian legislation concerning to health is extremely complex and, in many cases, in need of improvement. Thus, this article will focus specifically on the legal and infra-legal rules, pertinent to the Consumer Protection Code and the National Supplementary Health System. In view of the above, this article aimed to carry out a bibliographic survey to build a narrative review, in order to compile scientific studies in the area and address the main related aspects of health legislation to obtain, compile and delimit the field of knowledge and performance of the Nurse Auditor, which allows the qualified exercise of his profession. In this same context, the purpose is to discuss the concept, objectives and techniques used in conducting a Nursing Audit, in addition to identifying, compiling and commenting on the Brazilian legislation dealing with the Consumer Protection Code and the Health System Supplementary, with specific reference to nursing auditing.
