Como as Cortes Internacionais de Direitos Humanos verificam as restrições de direitos fundamentais em períodos de crise

O presente artigo tem como objetivo analisar o posicionamento da corte interamericana de direitos humanos em tempos de crise, relacionado às restrições de garantias e direitos fundamentais e, no presente estudo voltado à pandemia do Covid-19 ante a grande potência viral que assolou o mundo, o trâmite para chegar às restrições. Foi utilizando o método indutivo, a parir de revisão de literatura relevante ao tema, o presente trabalho também tem a função explicativa ao dissecar e trazer a conhecimento os conceitos apontados pela doutrina referente ao título do trabalho, a saber: Cortes Internacionais, Direitos e Garantias Fundamentais, Restrições, Tempos de Crise e visão/atuação das cortes internacionais.

  • Abstract: This article aims to analyze the position of the inter-American court of human rights in times of crisis, related to the restrictions of guarantees and fundamental rights and, in the present study focused on the Covid-19 pandemic, in the face of the great viral power that devastated the world, the procedure to reach the restrictions. Using the inductive method, along with a review of literature relevant to the subject, this work also has an explanatory function by dissecting and bringing to light the concepts pointed out by the doctrine referring to the title of the work, namely: International Courts, Rights and Guarantees Fundamentals, Restrictions, Times of Crisis and vision/action of the international courts.
