AS SENZALAS DA MODERNIDADE: O DESEMPENHO DO TRABALHO DOMÉSTICO FRENTE AO DESRESPEITO AOS PRECEITOS DE DIREITOS HUMANOS FUNDAMENTAIS
O presente estudo propõe-se a examinar de forma objetiva e sintética as condições de desempenho do trabalho doméstico ao longo da história e sua situação frente ao atual cenário jurídico brasileiro. O objetivo geral concentra-se, portanto, em evidenciar, por meio da presente pesquisa, a (in)existência do emprego doméstico em condições análogas à escravidão. No que tange ao objetivo específico, busca-se averiguar alguns dos principais prejuízos que podem ser gerados ao empregado que labora sob essas circunstâncias e quais fatores auxiliam essa problemática. Dessa forma, a temática abordada nesta pesquisa científica demonstra ser de grande relevância, uma vez que o problema analisado neste estudo é identificável nos mais diversos lares, apesar de existir no ordenamento jurídico moderno um vasto corpo normativo que veda a persistência de relações de trabalho fora dos ditames legais. Conclui-se, a partir do presente estudo, que apesar do inestimável valor do desenvolvimento na regulamentação jurídica da presente relação de emprego, este não é fator capaz de evitar a persistência de relações laborais em âmbito doméstico em situação análoga à escravidão, o que demonstra a necessidade de se buscar ações que visem sensibilizar a todos sobre a temática tratada, além da necessidade de efetuar denúncias sempre que identificadas tais situações de trabalho

Abstract:
This present study aims to examine objectively and synthetically the performance conditions of household chores throughout history and its situation in the current Brazilian legal scenario. The general objective is, therefore, to highlight, through this present research, the (in) existence of household chores in similar conditions to slavery. With regard to the specific objective, we seek to ascertain some of the main losses that can be generated to the employee who works under those circumstances and what factors help that problem. Thus, the theme addressed in this scientific research proves to be of great relevance, since the problem analyzed in this study is identifiable in the most diverse homes, despite the existence of a vast normative body in the modern legal system that prohibits the persistence of work relationships outside legal dictates. It is concluded, from the present study, that despite the inestimable value of the development in the legal regulation of the present household employment relationship, this is not a factor capable of avoiding the persistence of household labor relations in analogous situation to slavery, which demonstrates the need to seek actions that aim to raise awareness of all about the topic addressed, in addition to the need to make complaints whenever such work situations are identified.
