ACESSIBILIDADE E PRESERVAÇÃO DO PATRIMÔNIO HISTÓRICO TEATRO AMAZONAS - IMPLICAÇÕES PARA O TURISMO
No Brasil, a preservação e a proteção do patrimônio histórico são direitos fundamentais estatuídos na Constituição Federal, que garante no inciso II, do parágrafo 1º, do artigo 216-A, a universalização do acesso aos bens e serviços culturais. Entretanto, em que pese a previsão constitucional de universalização do acesso aos bens e serviços culturais, é notória a fragilidade de acesso a estes bens às pessoas com deficiência ou mobilidade reduzida, especialmente no tocante a transitabilidade em patrimônios históricos. Este trabalho busca identificar o atendimento das condições de acessibilidade versus a preservação do atrativo turístico Teatro Amazonas – patrimônio histórico de maior expressão cultural da cidade de Manaus – e suas implicações para o Turismo, tendo como objetivo geral demonstrar alternativas de como garantir a efetividade dos direitos fundamentais referentes a proteção e preservação do patrimônio histórico e a acessibilidade, e como objetivos específicos: a) Destacar o papel do tombamento como instrumento de tutela do patrimônio histórico; b) Descrever o atendimento das condições de acessibilidade do Teatro Amazonas; c) Traçar o perfil do turista com deficiência ou mobilidade reduzida; d) Elencar alternativas para assegurar o turismo acessível sem comprometer a integridade do patrimônio histórico cultural do referido atrativo turístico. Busca-se propor um modelo de gestão para conciliar a efetividade dos direitos fundamentais referentes a preservação do patrimônio histórico e a acessibilidade no Teatro Amazonas. Para tanto, se realizou a
revisão bibliográfica do tema, uma pesquisa in loco do referido patrimônio com a análise do atendimento da legislação de acessibilidade, bem como a aplicação de duas pesquisas. Uma sobre o comportamento do viajante com deficiência ou mobilidade reduzida e outra sobre a percepção dos funcionários do atrativo turístico objeto deste estudo relativamente ao atendimento das necessidades dos visitantes com algum tipo de deficiência. O resultado foi o mapeamento de não conformidades dos requisitos legais da acessibilidade, o quanto que a acessibilidade impacta na atividade turística, bem como a possibilidade de adaptabilidade do patrimônio tombado para atender, concomitantemente, aos princípios constitucionais de Acessibilidade e proteção do patrimônio histórico cultural para o desenvolvimento do turismo acessível.

Abstract:
In Brazil, the preservation and protection of historical heritage are fundamental rights enshrined in the Federal Constitution, which guarantees the universal access to cultural goods and services in item II, paragraph 1, of article 216-A. However, despite the constitutional provision for universal access to cultural goods and services, the fragility of access to these goods to people with disabilities or reduced mobility is notorious, especially with regard to the transitability of historical heritage. This work seeks to identify the fulfillment of the conditions of accessibility versus the preservation of the tourist attraction Teatro Amazonas - historical heritage of greater cultural expression in the city of Manaus - and its implications for Tourism, with the general objective of demonstrating alternatives on how to guarantee the effectiveness of rights fundamental aspects related to the protection and preservation of historical heritage and accessibility, and as specific objectives: a) Highlight the role of the listing as an instrument of protection of historical heritage; b) Describe the fulfillment of the accessibility conditions of Teatro Amazonas; c) To draw the profile of tourists with disabilities or reduced mobility; d) List alternatives to ensure accessible tourism without compromising the integrity of the cultural heritage of that tourist attraction. It seeks to propose a management model to reconcile the effectiveness of fundamental rights regarding the preservation of historical heritage and accessibility at Teatro Amazonas. To this end, the bibliographic review of the topic, an on-site survey of said heritage with the analysis of compliance with accessibility legislation, as well as the application of two surveys. One on the behavior of travelers with disabilities or reduced mobility and another on the perception of employees of the tourist attraction object of this study in relation to meeting the needs of visitors with some type of disability. The result was the mapping of non-conformities of the legal accessibility requirements, the extent to which accessibility impacts tourism activity, as well as the possibility of adaptability of the heritage listed to meet, at the same time, the constitutional principles of Accessibility and protection of cultural heritage for the development of accessible tourism.
