A REESTRUTURAÇÃO PRODUTIVA E A (DES) REGULAÇÃO JURIDICA DO TRABALHO MIGRANTE
O fenômeno contemporâneo das migrações espelha a fluidez e informalidade da força de trabalho inerentes à fase de acumulação flexível em um contexto de capitalismo neoliberal globalizado. Embora se possa inferir do teor de normas internacionais e nacionais o reconhecimento da necessidade de proteção ao trabalhador migrante, tais regramentos jurídicos desconsideram a porção majoritária de trabalhadores migrantes que atua informalidade, o que evidencia aparente contradição. Pelo método lógico dedutivo e a partir de pesquisa bibliográfica afasta-se o aparente paradoxo, à vista da inseparabilidade entre forma mercadoria e forma jurídica, ambas vinculadas à sociabilidade que caracteriza o modo de produção capitalista, demonstrando que o intento perseguido pelos interesses do capital é justamente a maior fluidez da força de trabalho que se converte em mercadoria, sem as amarras da legislação protetiva que limita a exploração.

Abstract:
The contemporary phenomenon of migration mirrors the fluidity and informality of the workforce inherent in the flexible accumulation phase in a context of globalized neoliberal capitalism. Although it can be inferred from the content of international and national norms the recognition of the need to protect migrant workers, such legal rules disregard the majority of migrant workers who work informally, which shows, at least in theory, contradiction. By the logical deductive method and based on bibliographic research the apparent paradox is removed, in view of the inseparability between commodity form and legal form, both linked to the sociability that characterizes the capitalist mode of production, demonstrating that the intent pursued by the interests of capital is precisely the greater fluidity of the workforce that becomes merchandise, without the bonds of the protective legislation that limits exploration.
