A QUALIDADE INSTITUCIONAL COMO PARADIGMA PARA A EXECUÇÃO DAS MEDIDAS SOCIOEDUCATIVAS
O presente trabalho tem o objetivo de analisar os aspectos da qualidade institucional que podem nortear a execução das medidas socioeducativas, em especial da liberdade assistida. O ponto de partida é o estudo das etapas históricas de responsabilização penal juvenil. Em seguida, são analisadas a natureza jurídica e a finalidade das medidas socioeducativas. A partir dessa análise, emerge a necessidade de estudo dos fundamentos das medidas socioeducativas, em especial da liberdade assistida. O estudo atinge seu ápice com a análise de aspectos da qualidade institucional na execução das medidas socioeducativas. Ao final, conclui-se que a qualidade institucional deve ser o paradigma para a execução da liberdade assistida de acordo com os fundamentos basilares desta medida, visando à reinserção social dos adolescentes infratores.

Abstract:
This study aims to analyze aspects of institutional quality that may guide the implementation of socio - educational measures, especially assisted freedom. The first point is to study the historical stages of juvenile criminal responsibility. Next, the legal nature and purpose of socio-educational measures are analyzed. From this analysis, the need to study the fundamentals of socio-educational measures, especially assisted freedom, emerges. The study reaches its apex with the analysis of institutional quality aspects in the execution of socio-educational measures. At the end, it is concluded that the institutional quality should be the paradigm for the execution of the assisted freedom according to the basic foundations of this measure, aiming at the social reintegration of the juvenile offenders.
