A PARTICIPAÇÃO DA SOCIEDADE NA INCLUSÃO DA PESSOA COM DEFICIÊNCIA: O DIREITO COMO INSTRUMENTO DE PROMOÇÃO DA DIGNIDADE HUMANA SOB O ASPECTO FRATERNAL
O presente trabalho tem por objetivo central discutir a questão da efetividade dos direitos fundamentais das pessoas com deficiência sob a ótica da fraternidade. Os direitos fundamentais, historicamente, são alvo de discussões que transcendem o plano interno do Estado nação, haja vista a sua relevância, pois se tratam de direitos que estão intimamente ligados à essência dos seres humanos e, portanto, são de interesse universal. A abordagem acerca do assunto parte da conquista dos direitos humanos, passando pelos direitos das pessoas com deficiência, que ganharam notoriedade a partir da Segunda Guerra Mundial, com o aumento do número de pessoas com deficiência e, em 1981 foi proclamado pela ONU o Ano Internacional da pessoa com deficiência, sob o lema: “Participação e Igualdade Plenas”. Por fim, chega ao ponto crucial da discussão, que é a efetividade dos direitos fundamentais das pessoas com deficiência, formalmente disciplinados, que culmina na tão necessária inclusão social das pessoas com deficiência. Para a pesquisa, foi utilizada a metodologia dedutiva, por intermédio de levantamento bibliográfico de obras que tratam do tema, com o objetivo de provocar uma reflexão sobre a participação da sociedade no cenário da inclusão social das pessoas com deficiência sob o aspecto fraternal dos seres humanos.

Abstract:
The main objective of this work is to discuss the issue of the effectiveness of the fundamental rights of people with disabilities under the perspective of the fraternity. Fundamental rights, historically, are the subject of discussions that transcend the internal plan of the nation state, to see its relevance, because these are rights that are closely linked to the essence of human beings and therefore are of interest Universal. The approach to the subject is part of the conquest of human rights, through the rights of people with disabilities, who gained notoriety from the Second World War, with the increase in the number of people with disabilities and, in 1981 was proclaimed by UN the International Year of the disabled person, under the motto: "Full Participation and equality". Finally, it reaches the crux of the discussion, which is the effectiveness of the fundamental rights of people with disabilities, formally disciplined, which culminates in the much-needed social inclusion of people with disabilities. For the research, the deductive methodology was used, through a bibliographical survey of works that deal with the theme, with the objective of provoking a reflection on the participation of the society in the scenario of the social inclusion of people with disabilities under the fraternal aspect of human beings.
