A JUSTIÇA E A META 19: QUESTÕES EM TORNO DO CONCEITO DE GESTÃO DEMOCRÁTICA
O texto debate a gestão democrática
do ensino a partir de um mapeamento sobre
as diferentes metodologias que dão acesso ao
cargo de diretor/gestor escolar e baseado em
experiências de municípios sul-rio-grandenses.
Problematiza a consequência direta do
silêncio das legislações reguladoras e da
ocorrência destas diferentes metodologias: a
judicialização da questão. Adota a metodologia
quali-quantitativa, baseada em questionários
e em análise documental. Apresenta a
problematização relacionada à meta 19 do
Plano Nacional de Educação, sob resguardo da
Lei 13.005/2014, no que tange ao provimento do
cargo do diretor/gestor escolar, evidenciando a
judicialização da questão. Ratifica a relevância
da Lei 13.005/2014, no que tange a necessária
regulamentação da questão, evitando que o
provimento ao cargo fique condicionado ao
debate jurídico.

Abstract:
The text discusses the democratic
management of teaching, from a mapping of
the different methodologies that can provide
access to the position of school manager at
the local level, based on the experiences of
South Rio Grande municipalities and especially
to question a direct consequence of silence
of the regulatory laws on the subject and the
occurrence of these different methodologies:
the legalization of the matter. Adopting a
qualitative and quantitative methodology based
on questionnaires and document analysis, the
text presents the questioning about the target
19 of Law 13.005/2014, especially concerning
the filling of the position of school manager,
evidencing the legal arguments used in the
legalization process of issue. In conclusion,
confirms the relevance of the text of Law 13,005
/ 2014 regarding the necessary regulation of
the issue, preventing one of the democratic
management mechanisms - the provision of
school manager - be conditioned exclusively to
the legal discussion on the subject.
