A JUDICIALIZAÇÃO DA GEOPOLÍTICA COMO ÚLTIMA FRONTEIRA EPISTEMOLÓGICA DO NEOCONSTITUCIONALISMO
O presente trabalho tem a finalidade de analisar as novas fronteiras epistemológicas do neoconstitucionalismo, que partem da hipótese de que geopolítica e democracia são vetores fundamentais à preservação dos direitos fundamentais do cidadão comum brasileiro. Ou seja, a busca do desenvolvimento geopolítico não deve se afastar dos pilares democráticos do Estado de Direito, daí a relevância do estudo da judicialização da geopolítica, no qual as grandes decisões geopolíticas do Estado brasileiro são levadas para julgamento do Poder Judiciário. É por isso que o presente artigo pretende examinar a necessária conexão epistemológica envolvendo o direito e a geopolítica, como elemento propulsor de uma nova hermenêutica do desenvolvimento nacional.

Abstract:
The present work aims to analyze the new epistemological frontiers of neoconstitutionalism, which start from the hypothesis that geopolitics and democracy are fundamental vectors for the preservation of the fundamental rights of ordinary Brazilian citizens. In other words, the search for geopolitical development must not depart from the democratic pillars of the rule of law, hence the relevance of the study of the judicialization of geopolitics, in which the major geopolitical decisions of the Brazilian State are brought to the Judiciary for judgment. That is why this article intends to examine the necessary epistemological connection involving law and geopolitics, as a driving force for a new hermeneutics of national development.
