A IMPORTÂNCIA DA PRESERVAÇÃO LEGAL DO ENTORNO DOS BENS INVENTARIADOS DO MUNICÍPIO DE SÃO LOURENÇO DO SUL, RS, BRASIL
Este trabalho objetiva promover o
debate acerca da preservação do entorno de
imóveis protegidos, patrimônio arquitetônico
inventariado, trazendo a discussão para
o município de São Lourenço do Sul, Rio
Grande do Sul, Brasil. Esse município, através
da Lei Municipal N.º 3.677/2016 “Inventário
do Patrimônio Cultural Arquitetônico de São
Lourenço do Sul”, inventariou 44 edificações
em sua área urbana, estabelecendo os níveis
de preservação e de conservação dessas
construções. Com esse trabalho, através
de uma revisão bibliográfica que inclui a
Legislação Federal, os documentos Legais e
Internacionais, como as Recomendações e
as Cartas Patrimoniais, poderá se verificar a
importância de se preservar não somente a
edificação “monumento”, mas também o seu
entorno, onde estão envolvidos aspectos como
visibilidade, ambiência e contexto histórico.
Esse assunto é exposto, para que o mesmo
possa servir de estímulo e de alerta, a fim
de instigar o desenvolvimento de estudos
específicos e conseqüentemente a proteção
legal do entorno dos bens inventariados
desse município. A preservação legal pode
ser prevista no Plano Diretor, por meio de
critérios de uso e de ocupação do solo para
áreas lindeiras às construções inventariadas,
bem como para novas ocupações no próprio
lote onde estão inseridos estes imóveis,
promovendo desta maneira, a compatibilidade
entre o crescimento urbano e a preservação
do patrimônio arquitetônico, o cumprimento da
função sociocultural da propriedade em busca
do bem coletivo, e a garantia da preservação
do bem material, da sua ambiência e da sua
contextualização histórica

Abstract:
This paper aims to promote
the debate about the preservation of the
environment of protected properties, inventoried
architectural patrimony, bringing the discussion
to the municipality of São Lourenço do Sul,
Rio Grande do Sul, Brazil. This city, through
Municipal Law N.º 3.677 / 2016 “inventory of
architectural cultural heritage of São Lourenço
do Sul”, inventoried 44 buildings in its urban area, establishing the levels of preservation and conservation of these constructions.
With this work, through a bibliographic review that includes the federal legislation, legal
and international documents, such as the recommendations and the heritage letters, it
may be verified the importance of preserving not only the “monument” building, but also
its surroundings, where aspects such as visibility, ambience and historical context are
involved. This subject is exposed, so that it can serve as a stimulus and alert, in order
to instigate the development of specific studies and consequently the legal protection
of the surroundings of the inventoried assets of that municipality. Legal preservation
can be foreseen in the master plan, through criteria of land use and occupation for
areas close to the inventories, as well as for new occupations in the lot where these
properties are inserted, thus promoting the compatibility between urban growth and the
preservation of the architectural patrimony, the fulfillment of the sociocultural function
of property in search of the collective good, and the guarantee of the preservation of
the material good, its ambience and its historical contextualization.
