A GARANTIA DO TRABALHO DECENTE PARA A MULHER TRANSEXUAL E PARA TRAVESTI, À LUZ DA PROTEÇÃO SOCIAL DO TRABALHO
O objetivo do artigo é trazer um breve histórico do papel da mulher, com foco nas mulheres transexuais e travestis, sua relação com o mercado de trabalho, as dificuldades do acesso ao direito de igualdade de oportunidade e ao direito à Proteção Social do Trabalho, em função da discriminação e do preconceito por gênero. Para uma aplicação equitativa do Direito do Trabalho, é fundamental a garantia de condições de trabalho decente, que incluem o respeito à legislação trabalhista e a um conjunto de políticas para proteger grupos especialmente vulneráveis da população trabalhadora. Como forma de demonstrar o desafio do Direito do Trabalho para atingir questões da contemporaneidade, como a que trazemos no artigo, discutiremos as lacunas das estruturas legais brasileiras para garantir direitos da população Trans. Outra questão igualmente relevante que trataremos é a seletividade excludente do Sistema de Justiça Brasileiro com relação à garantia de direitos das mulheres, sobretudo as transexuais, e como isso tem refletido em algumas de suas decisões. A metodologia será analisar as poucas leis de proteção da população LGBT no Brasil, a análise dos julgados sobre discriminação de LGBTs com foco nas travestis e mulheres transexuais no trabalho, a aplicabilidade dos direitos fundamentais, a análise das leis supralegais que garantem direitos universais, incluindo as Resoluções Internacionais, Tratados, Convenções da OIT e iniciativas de boas práticas governamentais e empresariais.

Abstract:
The objective of this article is to provide a brief history of the role of women, focusing on transsexual and “travestis” women. The article will explore their relationship with the labor market and the difficulties they face to access equal opportunities and the right to Social Protection at Work, due to gender discrimination. For a fair application of labor law, it is essential to ensure decent work conditions, which include respecting labor legislation and policies that protect particularly vulnerable groups of workers. As a way of demonstrating the challenge of the Right of Work to reach contemporary issues, such as the one we address in this article, we will discuss the gaps in Brazil’s legal structures that compromise its capacity to guarantee the rights of Transgender people. Another equally relevant issue that we will address is the exclusionary and selectivity character of the Brazilian Justice System in relation to the guarantee of women's rights, especially transsexuals, and how this has been reflected in some decisions. The methodology used is an analysis of the few laws that protect the LGBT population in Brazil and of judgments on discrimination against LGBT people, with a focus on “travestis” and transsexual women at work, as well as the applicability of fundamental rights and the analysis of supralegal laws that guarantee universal rights, including International Resolutions, Treaties, ILO Conventions and initiatives of good governmental and business practices.
