A ESCOLARIZAÇÃO E A APRENDIZAGEM PROFISSIONAL DE SOCIOEDUCANDOS EM CUMPRIMENTO DE MEDIDA SOCIOEDUCATIVA DE SEMILIBERDADE: dados de realidade e possibilidades
A sistematização traz síntese de levantamento de dados realizado a partir dos registros de atendimentos técnicos, referentes a escolarização, aprendizagem profissional e empregabilidade de socioeducandos que passaram pelo Centro de Atendimento de Semiliberdade de Caxias do Sul, no período de junho de 2015 a junho de 2016. Como também, reflexões sobre as dificuldades presentes e retratadas nos dados, e o relato de experiência que busca suprir dificuldades através de proposta de garantias de oportunidades para socioeducandos. Tal síntese e reflexões são antecedidas por um resgate histórico sobre o atendimento dispensado ao público infanto-juvenil no âmbito internacional e nacional e suas principais normativas, no intuito de melhor compreensão sobre a configuração da Semiliberdade na atualidade e o direito a escolarização e profissionalização. A semiliberdade, assim como as demais medidas socioeducativas, são respostas formais do Estado aplicáveis a adolescentes que cometem ato infracional, previstas no Estatuto da Criança e do Adolescente (Lei Nº 8.069/1990) e regulamentada através do Sistema Nacional de Atendimento Socioeducativo (Lei Nº 12.594/2012). Conforme o Art. 120, §1º do ECA que trata da Semiliberdade: “São obrigatórias a escolarização e a profissionalização, devendo, sempre que possível, serem utilizados os recursos existentes na comunidade”. Todavia, essas obrigatoriedades encontram diversas barreiras para a sua concretização.

Abstract:
The article, set up as a case study and experience report, presents a summary of the data obtained from the records of technical attendance, referring to schooling, professional learning and employability of socio-educators who passed through the Semi- release Service Center (Centro de Atendimento de Semiliberdade) in Caxias do Sul, from June 2015 to June 2016. As well as reflections on the present diffculties and portrayed in the data, and the report of experience that seeks to overcome diffculties through the proposal of guarantees of opportunities for socio-students. Such synthesis and reflections are preceded by a historical rescue on the care given to children and adolescents at the international and national levels and its main norms in order to better understand the confguration of semi-open prison nowadays and the right to schooling and professionalization. Semi-liberty, as well as other socio-educational measures, are formal State responses applicable to adolescents who commit an offense, as provided for in the Statute of the Child and Adolescent (Law No. 8,069 / 1990) and regulated through the National Socio-Educational Assistance System (Law 12,594 /2012). According to article 120, §1 of the Statute of the Child and Adolescent that deals with Semi-release prison: “Schooling and professionalization are obligatory, and whenever possible, the existing resources in the community should be used”. However, these constraints have several barriers to their implementation.
