A Corte Inter-Americana de Direitos Humanos e a justiça de transição no Brasil
Este artigo procura entender a articulação dos atores e forças políticas em torno das leis internacionais de direitos humanos e como as mudanças legislativas em nível global influenciaram políticas nacionais no Brasil. Para tanto, realizamos um estudo de caso da condenação do Brasil pela Corte Interamericana de Direitos Humanos (CIDH) no caso Gomes Lund e outros versus Estado brasileiro. O objetivo é identificar como no período entre 2010 e 2020 a condenação internacional influenciou as modificações ocorridas nas leis internas e as medidas de justiça de transição do país. Parte-se do pressuposto que a CIDH teve legitimidade para garantir estas mudanças e, portanto, influenciar a dinâmica que o país vinha adotando até então. O artigo também discute quais mecanismos foram utilizados pelas instituições democráticas nacionais para garantir o cumprimento das medidas determinadas pela sentença.
Utilizaremos a técnica do process tracing para reconstruir a sequência dos julgamentos na CIDH a partir dos documentos disponíveis. Com base na reconstrução formularemos uma narrativa explicativa para analisar os principais argumentos utilizados em cada fase do julgamento, bem a articulação dos atores políticos envolvidos na defesa de seus interesses.

Abstract:
This article seeks to understand the articulation of actors and political forces around international human rights laws and how legislative changes at the global level have influenced national policies in Brazil. To this end, we conducted a case study on the condemnation of Brazil by the Inter-American Court of Human Rights (IACHR) in the case of Gomes Lund et al. Versus the Brazilian State. The objective is to identify how in the period between 2010 and 2020 international condemnation influenced the changes in domestic laws and the country's transitional justice measures. It is assumed that the IACHR had the legitimacy to guarantee these changes and, therefore, influence the dynamics that the country had been adopting until then. The article also discusses what mechanisms were used by national democratic institutions to ensure compliance with the measures determined by the sentence. We will use the process tracing technique to reconstruct the sequence of trials in the IACHR from the available documents. Based on the reconstruction, we will formulate an explanatory narrative to analyze the main arguments used in each phase of the trial, as well as the articulation of the political actors involved in the defense of their interests
