A AUTORIDADE NACIONAL DE PROTEÇÃO DE DADOS DIANTE DA (IN)SEGURANÇA NO CIBERESPAÇO: UM DESAFIO
Com a contínua expansão das tecnologias da informação na Sociedade em Rede observa-se um aumento do uso da Internet por usuários, que constantemente estão gerando dados online. Atualmente esses dados movimentam a economia, pautada na tecnologia e na informação. O conhecimento está diretamente ligado ao poder econômico. Em busca de assegurar direitos como a proteção de dados, o direito à intimidade e à privacidade, surge a necessidade da elaboração de normas a fim de regulamentar esse espaço digital. A presente pesquisa versa sobre a Autoridade Nacional de Proteção de dados nesse cenário digital e dos riscos que emanam dessa relações online. A metodologia utilizada foi um estudo descritivo-analítico, com abordagem qualitativa, visando corroborar com o estabelecimento de uma melhor e mais segura política de proteção de dados através das funções conferidas à ANPD. Assim, diante disso, conclui-se que a insegurança advinda da vida digital consiste no problema central do ciberespaço, sendo um desafio para ser totalmente solucionado, devido a dificuldade de controle dos dados e anonimato na rede mundial de computadores. Entretanto, a criação da ANPD é um passo rumo à uma maior promoção de segurança nas relações digitais, aumentando a fiscalização do tratamento com dados e aplicando a LGPD.

Abstract:
With the continuous expansion of information technologies in the Network Society, there is an increase in the use of the Internet by users, who are constantly generating data online. These data currently drive the economy, based on technology and information. Knowledge is directly linked to economic power. In search of ensuring rights such as data protection, the right to intimacy and privacy, there is a need to develop standards in order to regulate this digital space. This research deals with the National Data Protection Authority in this digital scenario and the risks that emanate from these online relationships. The methodology used was a descriptive-analytical study, with a qualitative approach, aiming to corroborate the establishment of a better and safer data protection policy through the functions conferred to the ANPD. Thus, in view of this, it is concluded that the insecurity arising from digital life is the central problem of cyberspace, being a challenge to be completely solved, due to the difficulty of controlling data and anonymity on the world wide web. However, the creation of ANPD is a step towards greater security promotion in digital relationships, increasing the inspection of data processing and applying the LGPD.
