A APLICABILIDADE DOS MÉTODOS ALTERNATIVOS DE SOLUÇÃO DE CONFLITOS NO DIREITO DO TRABALHO
O presente artigo versa acerca dos métodos alternativos de solução de conflitos e a arbitragem no direito do trabalho e tem-se como objetivo geral da pesquisa o estudo dos meios cabíveis para resolução de conflito entre empregador e empregado, bem como uma compreensão a luz da Consolidação das Leis Trabalhistas. Para melhor compreensão, o artigo é dividido em três partes. Na primeira parte será analisado a relação entre empregador x empregado, vínculo contratual que pode acarretar litígios. Em um segundo momento, o presente trabalho abordará os meios de solução de conflitos, onde visa buscar uma solução fora do Poder Judiciário, por métodos que visam desafogar o Judiciário, solucionando o litígio. No terceiro ponto o foco é voltado especialmente a arbitragem, carro chefe na busca pela resolução de conflitos. O estudo faz uso da pesquisa utilizando a produção descritiva e observando a Normalização dos Trabalhos Acadêmicos da Universidade Alto Vale do Rio do Peixe (UNIARP) e regras da Associação Brasileira de Normas Técnicas (ABNT).

Abstract:
This article deals with alternative methods of conflict resolution and arbitration in labor law and the general objective of the research is the study of the appropriate means for resolving the conflict between employer and employee, as well as an understanding in the light of the Consolidation of Labor Laws. For better understanding, the article is divided into three parts. In the first part, the relationship between employer and employee will be analyzed, contractual relationship that may lead to disputes. In a second moment, the present work will address the means of conflict resolution, where it aims to seek a solution outside the judiciary, by methods that aim to relieve the judiciary, solving the dispute. In the third point the focus is especially focused on arbitration, chief car in the search for conflict resolution. The study makes use of the research using descriptive production and observing the Standardization of Academic Papers of the Alto Vale Do Rio do Peixe University (UNIARP) and rules of the Brazilian Association of Technical Standards (ABNT).
