ZONAS ESPECIAIS DE INTERESSE SOCIAL (ZEIS) E REGULARIZAÇÃO FUNDIÁRIA: AVANÇOS E DESAFIOS JURÍDICOS NA GARANTIA DO DIREITO À CIDADE

Este artigo aborda as Zonas Especiais de Interesse Social (ZEIS) no contexto da regularização fundiária no Brasil, com o propósito de analisar seus avanços e limitações. As ZEIS são fundamentais para a inclusão social e a promoção do direito à cidade, oferecendo possibilidades de regularização de assentamentos urbanos informais e promovendo o acesso à infraestrutura e serviços urbanos. Contudo, o artigo destaca as principais dificuldades enfrentadas na implementação das ZEIS, como a falta de articulação entre políticas públicas, a precariedade da infraestrutura urbana e a resistência a projetos de urbanização nas áreas mais vulneráveis. A pesquisa, de caráter exploratório e qualitativo, utiliza o método de abordagem dialético, o que permite analisar a dinâmica entre os fatores que influenciam a efetividade das ZEIS. A metodologia inclui o procedimento histórico e a técnica de pesquisa indireta, por meio de análise documental e bibliográfica, permitindo um entendimento mais profundo das políticas públicas que envolvem as ZEIS e suas implicações para a regularização fundiária. Os resultados revelam que, apesar dos avanços significativos, as ZEIS ainda enfrentam obstáculos em sua aplicação, o que requer maior integração entre as políticas habitacionais, ambientais e urbanísticas.

  • Abstract: This research aims to analyze the possibility of applying the investigative technique known as criminal profiling in the field of inteligent investigation, as well as its use as proof in criminal process. Given that, despite all its historical development and relation with the sciences of criminology, sociology, psychology and criminalistics, its scientific validity is still the subject of discussion among specialists in the field, which provides a question about its validity and effectiveness in criminal persecution. In addition, it is appropriate to correlate the theme with the current Brazilian scenario regarding to the relentless and constant increase in crime rates, chaotic situation that plagues the country and calls for innovations in the area of ​​investigative procedure, especially regarding violent crimes, since lamentably, this ambit is completely outdated, obsolete and unable to follow the growing wave of violence in the country. Facing this problematic, it is urgent that there is incentive from the State to improve the brazilian investigative structure by promoting research that explores the validity of promising new techniques such as criminal profiling in order to obtain an inteligent and improved investigative system. This is an exploratory and qualitative research with the application of the dialectical approach method, as well as the historical procedure method and indirect research technique through documentary and bibliographic research.
