VIOLÊNCIA CONTRA A MULHER: DETERMINANTES NO CONTEXTO FAMILIAR E GARANTIA DOS DIREITOS HUMANOS
Por toda a história da humanidade a diferença entre o homem e a mulher
foi contraponto para o desenvolvimento social de forma igualitária e justa, e para que
exista igualdade é necessário entendimento e respeito. As mulheres que sofrem
violência doméstica carregam consigo sentimentos de abandono, baixa autoestima,
tristeza. O objetivo desta pesquisa é mostrar quais as determinantes da violência
contra a mulher no contexto familiar, bem como os mecanismos de garantia dos
direitos humanos à mulher. Foi realizado um levantamento bibliográfico e
documental. Fatores histórico-ideológicos como aquele que torna legitimo o poder
do homem sobre a mulher, havendo inclusive possibilidade de uso de força física,
devido ao machismo, uma prática cultural, exercida pelo homem sobre a mulher
como ato corretivo; fatores pedagógicos, que se relaciona com a forma com a qual
somos ensinados sobre as relações pertinentes aos direitos masculinos e femininos;
fatores estruturais, que se referem ao questionamento sobre a condição feminina, a
sua dependência do homem, o auto sustento, que por não poder exercer funções
fora a de “dona de casa” as mulheres não tinham renda e muito menos participação
nas decisões a respeito das obrigações da casa. Assim, entende-se que a norma
jurídica foi de extrema importância para a quebra de paradigmas sociais, e a
mudança na estigmatização que as mulheres carregaram durante toda a vida.

Abstract:
Throughout the history of mankind, the difference between man and
woman was counterpoint to social development in an egalitarian and just way, and
for there to be equality, it is necessary to understand and respect. Women who
experience domestic violence carry with them feelings of abandonment, low selfesteem, sadness. The objective of this research is to show the determinants of
violence against women in the family context, as well as mechanisms to guarantee
the human rights of women. A bibliographic and documentary survey was carried out.
Historical-ideological factors such as the one that makes legitimate the power of the
man on the woman, having even possibility of use of physical force, due to the
machismo, a cultural practice, exerted by the man on the woman like corrective act;
pedagogical factors, which relates to the way in which we are taught about the
relations relevant to male and female rights; structural factors, which refer to the
questioning of the female condition, its dependence on men, self-support, which,
because it could not perform functions other than the "housewife", women had no
income and much less participation in decisions about them of the house. Thus, it is
understood that the legal norm was of extreme importance for the breakdown of
social paradigms, and the change in the stigmatization that women carried
throughout their lives.
