“UTILITARISMO NORMATIVO”: BREVES CONSIDERAÇÕES SOBRE AS INFLUÊNCIAS NO PROCESSO CIVIL
Constata-se a emergência de um estágio metodológico do direito processual civil capaz de superar as visões tradicionais e de trazer uma justificação do processo de forma a evidenciar uma racionalidade filosófica autônoma em relação ao direito material. Seu referencial teórico se alargou no utilitarismo de normas, por intermédio do qual se constrói o método processual consequencialista-pragmático. Contudo, a crítica à racionalidade utilitarista é complexa na medida em que existem diferentes registros do utilitarismo: sobretudo, aqui, enfoca-se o utilitarismo de ato e de regras, mostrando como este último repercute diretamente nas normas institucionais, tal qual as do processo civil. Por último, registra-se que não se prescinde de outros carizes, mormente a carga axiológica advinda da necessidade de um processo democrático e que garanta direitos individuais, apenas, reforça-se o impacto do utilitarismo para a fase metodológica do instrumentalismo processual em uma verdadeira linguagem descritiva de uma realidade metodológica que mais perdura na ciência processual hodierna. Com isso, coteja-se existe um único critério filosófico de justiça?

Abstract:
There is the emergence of a methodological stage of civil procedural law capable of overcoming the traditional views and bringing a justification of the process in order to highlight an autonomous philosophical rationality in relation to material law. Its theoretical reference has been extended in the utilitarianism of norms, through which the consequentialist-pragmatic procedural method is constructed. However, the critique of utilitarian rationality is complex insofar as there are different registers of utilitarianism: above all, the utilitarianism of act and rules is focused on, showing how the latter has a direct impact on institutional norms, such as those in the civil process. Finally, it is noted that other aspects are not dispensed with, especially the axiological burden arising from the need for a democratic process and guaranteeing individual rights, only reinforces the impact of utilitarianism for the methodological phase of procedural instrumentalism in a true language. description of a methodological reality that endures most in today's procedural science. With this, is there a single philosophical criterion of justice?
