UMA REFLEXÃO DA RACIONALIDADE A PARTIR DO FILME RADIOACTIVE: CONCRETIZAÇÃO DO ESTADO DEMOCRÁTICO DE DIREITO AMBIENTAL NO BRASIL?
Neste artigo, a partir do recurso estético proporcionado pela linguagem audiovisual do filme Radioactive, e com a intenção de que a arte analisada sob o ponto de vista do direito provoque possível mudança de mentalidade no leitor, demonstrou-se a crise verificada com a mentalidade positivista moderna, essa norteadora da racionalidade econômica, consumerista e tecnológica de coisificação e superexploração da natureza. Em seguida, com a virada propiciada pela nova racionalidade ambiental, fundada no pensamento crítico que (re)funcionalizou os direitos da natureza em prol da vida e através de uma política ética ambiental, convivencial e sustentável, que admite a realidade a partir da complexidade, discorreu-se sobre a consagração legal e constitucionalizada do Estado Democrático de Direito Ambiental no Brasil, para, em seguida, responder se diante da atual conjuntura vivenciada por esse Estado Ambiental há, de fato, a sua concretização. A metodologia utilizada consiste em uma pesquisa bibliográfica, documental, pura, exploratória e qualitativa. Concluiu-se que há a necessidade de o Estado brasileiro implementar políticas públicas capazes de conciliar a proteção ao meio ambiente e o desenvolvimento econômico e sustentável, de modo que haja a concreta efetivação de um Estado Democrático de Direito Ambiental.

Abstract:
In this article, based on the aesthetic resource provided by the audiovisual language of the film Radioactive, and with the intention that the art seen from the point of view of the law provokes a possible change of mentality in the reader, the crisis verified with the positivist mentality was demonstrated. modern, this guiding economic, consumerist and technological rationality of objectification and overexploitation of nature. Then, with the turn brought about by the new environmental rationality, founded on critical thinking that (re) functionalized the rights of nature in favor of life and through an environmental, convivial and sustainable ethical policy, which admits reality from the complexity, the legal and constitutionalized consecration of the Democratic State of Environmental Law in Brazil was discussed, in order to then answer whether, in view of the current situation experienced by this Environmental State, there is, in fact, its realization. The methodology used consists of a bibliographic, documentary, pure, exploratory and qualitative research. It was concluded that there is a need for the Brazilian State to implement public policies capable of reconciling environmental protection and economic and sustainable development, so that there is a concrete implementation of a Democratic State under Environmental Law.
