UMA OUTRA GLOBALIZAÇÃO: SOBERANIA CONDICIONADA DOS ESTADOS-NAÇÃO, CORROSÃO DA DEMOCRACIA, EXAUSTÃO DOS SISTEMAS JURÍDICOS E ESVAZIAMENTO DE DIREITOS
Um traço essencial da globalização é seu caráter contraditório, pois ao mesmo tempo em que permite incríveis avanços em várias áreas - econômica, científica, social, etc. - também rompe com modelos postos. Sob o prisma das rupturas, a integração dos mercados de capitais permite que forças financeiras ingiram na política interna de nações pobres e imponham, como condição de investimento, a adoção de agendas ultraliberais que anulem o Estado-providencia, concedam isenções fiscais, reduzam políticas assistenciais e esgotem direitos, e outros. Os efeitos desse processo se materializam no abatimento da soberania nacional dos Estados, no esvaziamento de direitos e desestabilização da ordem democrática. Além disso, o surgimento caótico de novos fenômenos sociais, excitados pela mundialização, tem causado o exaurimento e o descrédito social dos sistemas legais tradicionais, quando estes, ao tentar regular tais fenômenos, mostram-se obsoletos e limitados. Então, o artigo visa analisar a relação entre a globalização e as citadas rupturas. O método adotado é descritivo e exploratório quanto ao objetivo, qualitativo quanto à abordagem e bibliográfico quanto ao procedimento.

Abstract:
An essential feature of globalization is its contradictory character, since at the same time it allows incredible advances in various areas - economic, social, scientific, etc. - also breaks with models put. In the light of disruptions, the integration of capital markets allows economic forces to engage the domestic politics of vulnerable nations and impose, as a condition for investment, the adoption of ultraliberal agendas that nullify the welfare state, improve competitive conditions, reduce taxes, exhaust rights, etc. The effects of this process materialize in the weakening of state sovereignty, the depletion of rights and the destabilization of the democratic order. Moreover, the chaotic emergence of new phenomena, excited by globalization, has caused the exhaustion of traditional legal systems. Showing these obsolete and limited, when trying to regulate these facts, they suffer social discredit and, in response, there is an intense legislative production, which causes disfigurement and swelling in these ordinances. This paper aims to analyze the relationship between globalization and the aforementioned ruptures. The method used is descriptive and exploratory as to the objective, qualitative as the approach and bibliographic as the procedure.
