UMA JURISDIÇÃO PARTICIPATIVA: MEDIAÇÃO
A sociedade está vivendo uma época de insegurança e medo, que se evidenciam nas guerras e corrupções, existindo um clamor social pela aplicação e concretização das leis existentes, e, no caso brasileiro, pela criação de leis mais rígidas e efetivas. Assim, o poder da jurisdição estatal já não é mais suficiente para trazer a pacificação à sociedade. Diante de tal cenário, não bastam apenas legislações novas ou interpretadas de variadas formas, nem teorias que se mantenham abstratas diante do mundo das ideias: há que se buscar a adequação das teorias à realidade social, à racionalização dos fatos vividos e sentidos. A aplicação da tutela jurisdicional atual deve ser repensada, tendo em vista a busca maior da aplicação dos valores éticos e na concretização da efetiva comunicação e conciliação entre as partes, colocando em prática uma jurisdição participativa voltada para a resolução célere e efetiva dos litígios sociais.

Abstract:
The society is living a time of uncertainty and fear, which are evident in the wars and corruption and there is a public outcry by the application and implementation of existing laws, and, in Brazil, the creation of more stringent and effective legislation. Thus, the power of state jurisdiction is no longer enough to bring peace to society. Faced with such a scenario, not enough just new laws or interpreted in different ways, or theories that remain abstract ideas before the world: it is necessary to seek the adequacy of theories to social reality, rationalizing lived and meanings facts. The application of the current legal protection should be rethought with a view to greater search application of ethical values and the implementation of effective communication and reconciliation between the parties, putting in place a focused participatory jurisdiction for the speedy and effective resolution of social disputes.
