Abstract: Non-refoulement is provided for in Article 22.8 of the American Convention on Human Rights and provides that none of the Contracting States shall expel a refugee to the borders of territories where his life or freedom is threatened on account of race, religion, nationality, social group to which you belong or political opinions. The work aims to discuss the role of the Inter-American Court of Human Rights in the Pacheco Tineo Family case, investigating the normative force and relevance of that principle. Bibliographic and legislative research was carried out, through the exposition and analysis of the norm, the approach was qualitative, using an indirect technique, having as research sources articles and books. It was found that Bolivia denied asylum to the family that was admittedly persecuted for political reasons in their country of nationality, having decided the body according to techniques of application of the international norm in dialog with different international sources of human rights.
