UMA ANÁLISE DO DIREITO FUNDAMENTAL EM TEMPOS DE ISOLAMENTO SOCIAL: REFLEXOS DA COVID-19
Objetivou-se analisar os reflexos decorrentes da pandemia do Covid-19, mormente o isolamento social, enquanto medida restritiva de direito fundamental. Trata-se de temática que ganha relevo, na medida em que o novo coronavírus ainda assola a humanidade e não há cura para a Covid-19, sendo as medidas de distanciamento social e isolamento social recomendadas pelo Poder Público para conter a disseminação do vírus, diminuir a curva de contágio e permitir que os estabelecimentos de saúde proporcionem atendimento adequado aos infectados. Porém, se de um lado há aqueles que defendem o isolamento social, de outro encontram-se ferrenhos críticos, que apontam a responsabilidade do Estado por medidas que obstam a liberdade de ir e vir dos cidadãos e o direito de empreender, evidenciando a relevância do tema. A pesquisa classifica-se como dedutiva, descritiva e bibliográfica. O isolamento social pode ser compreendido, em tempos de pandemia, como uma medida jurídica indispensável, ainda que implique na relativização do direito fundamental? Constatou-se que o isolamento social deve ser compreendido como um instrumental jurídico que leva à preservação do direito fundamental, já que decorre da consagração das liberdades e do direito à saúde, devendo o Estado assegurar meios para a efetivação do isolamento daqueles que assim desejam enfrentar a pandemia do Covid-19.

Abstract:
The objective was to analyze the consequences resulting from the Covid-19 pandemic, especially social isolation, as a restrictive measure of fundamental right. This is a theme that gains importance, as the new coronavirus still plagues humanity and there is no cure for Covid-19, and the measures of social distancing and social isolation are recommended by the Government to contain the spread of the virus, reduce the contagion curve and allow health establishments to provide adequate care to those infected. However, if on the one hand there are those who defend social isolation, on the other there are staunch critics, who point out the State's responsibility for measures that impede the freedom to come and go of citizens and the right to undertake, highlighting the relevance of theme. The research is classified as deductive, descriptive and bibliographical. Can social isolation be understood, in times of pandemic, as an indispensable legal measure, even if it implies the relativization of fundamental rights? It was found that social isolation must be understood as a legal instrument that leads to the preservation of the fundamental right, as it results from the enshrinement of freedoms and the right to health, and the State must ensure the means to effect the isolation of those who thus wish to face the Covid-19 pandemic.
